Brief Summary
The Ethics Committee of the Colorado Bar Association concluded that the Rules of Professional Conduct prohibit lawyers from participating in “Collaborative Law” if it requires a contractual obligation between the lawyer and the opposing party in which the lawyer agrees to terminate the representation of the client if the process is unsuccessful. Lawyers may participate in such a process only if they comply with all of the Rules of Professional Conduct.
