The United States Patent Trademark Office (“USPTO”) has proposed supplementary rule changes that would, among other things, clarify the extent to which federal authorization to appear and practice before the USPTO preempts the right of states to prohibit lawyers who are officed, but not licensed, in the state to engage in patent-related activities.
