California Appellate Court Finds Excessive Billing is a Violation of Fiduciary Duty
Martha Charnay v. Joseph M. Colbert, 51 Cal. Rptr. 3d 471 (Cal. App. 2 Dist. 2006)
Brief Summary
The court held that allegations the defendant lawyer billed for services not provided and inflated rates for services provided by his staff properly stated a claim for breach of fiduciary duty and that an action for the same would not be subject to any time limits set forth in the retainer agreement for billing disputes.
