Ethics Committee Rejects Attempt to Create Attorney-Client Relationship or Duty of Confidentiality Based Solely on Unsolicited Email to Prospective Attorney

Brief Summary

The committee refused to find an attorney-client relationship or a duty of confidentiality in favor of a prospective client when a prospective client obtained the attorney’s email address through the state bar website and then sent the attorney unsolicited confidential information. The committee also held that the attorney who received the information could use it against the sender in representing a party in the same case.
