California Supreme Court Rejects Screening for San Francisco City Attorney

Brief Summary

An attorney who represented a client while in private practice was elected City Attorney of San Francisco. Several months after his election, the City Attorney’s office named a former client of the City Attorney as a defendant in a claim brought by the City for fraud, statutory violations and breach of contract. The former client sought disqualification of the entire City Attorney’s office, arguing that the City Attorney’s personal conflict should be imputed to the entire office. The California Supreme Court agreed.
