Brief Summary
Two questions are critical to the assessment of this case: (1) whether, or to what extent, other types of representation with an arguably analogous public component will be held assignable in Florida and (2) whether other jurisdictions will follow Florida’s lead. Since non-assignability has at times been an important defense against legal malpractice claims, this case may not bode well for law firms and their insurers.
