Illinois Court Holds that Lawyers May Be Liable in Legal Malpractice for Punitive Damages Not Recovered in the Underlying Case

Brief Summary
It remains to be seen whether the Illinois Supreme Court will accept review of this decision and, if so, what the court will decide. At least for the time being, however, there is contemporary authority both for and against the collectability of punitive damages in a legal malpractice action. Over time, we are likely to see more appellate decisions from more states on this issue.
