Attorney Should Inform Client of Alternative Avenues of Relief
Janik v. Rudy, Exelrod & Zieff LLP
Alameda County Superior Court, Case No. 2002070478
Alameda County Superior Court, Case No. 2002070478
Brief Summary
Janik clarifies that an attorney who is aware of claims that are related to the client's recovery, but which have not been asserted, should inform his client of such alternative avenues of relief and allow the client to consider if he wishes to pursue them. Though it is not clear if this ruling is limited to class actions or all cases, it would appear that the court supports the notion that informing a client of such related or alternative claims would fall within the expected skill, prudence, and diligence of an attorney and meet the standard of care.
